Impaired driving and DUI defence in Kitchener-Waterloo

Impaired driving and over 80 charges carry consequences well beyond a licence suspension. They are Criminal Code charges, not provincial offences, and a conviction leaves a criminal record with lasting effects on insurance, employment and travel.

The Crown must prove its case according to law. That means the manner of the stop, the grounds for any demand, the operation of the screening and breath-testing instruments, and your rights are all open to scrutiny. Charter issues often arise in impaired driving cases, including the right to counsel, whether a detention was reasonable and whether a demand was lawful. Where a breach is established, evidence may be excluded.

Where defences arise

  • The stop and the demand: whether police had lawful grounds
  • Right to counsel: whether you were properly told about, and allowed to use, your right to speak with a lawyer
  • Instrument and procedure: whether the screening device and approved instrument were operated correctly

Initial consultations are free, confidential and without obligation. Meetings are by appointment; if you have been arrested, call directly.
