Description

We are Genesee Law, a Hamilton criminal defence firm serving Hamilton and nearby Stoney Creek and Ancaster. Our principal, Frank Genesee, has practised criminal law for more than 40 years, with a particular focus on alcohol-related driving offences, and has appeared at many levels of court in Ontario.

Impaired driving defence in Hamilton

If you are accused of impaired driving, of operating a vehicle with a blood alcohol concentration over the legal limit, or of refusing breath or drug testing, the consequences can be severe. Driving while impaired by alcohol or drugs is a Criminal Code offence, and recent amendments have given prosecutors a more straightforward path to conviction, so experience in this area matters.

Once we are retained, we require the Crown to provide full disclosure: the officers’ notes, video of the breath testing, breathalyzer data and witness statements. We scrutinize that material to develop the right defences, interview you and any defence witnesses, and attend resolution meetings with the Crown and judicial pretrials.
