Description

We are Raftery Law, a criminal defence firm in the heart of downtown Hamilton, led by Cole Raftery. Cole has more than 30 years of courtroom experience. He articled with Arthur Maloney, Q.C., worked as an Assistant Crown Attorney in Hamilton, and then chose criminal defence because he would rather keep people out of jail than put them in.

Impaired driving defence in Hamilton

For many people, an impaired driving charge is their first contact with the police and the courts, and it is frightening not to know your rights. Whether you are charged with impaired driving, driving over 80 (more than 80 milligrams of alcohol in 100 millilitres of blood) or refusing to provide a breath sample, the best step is to speak with a lawyer who handles these cases.

The defences available depend on your situation. They can include the accuracy of the breath instrument, a breach of your constitutional rights or the timing of the tests. Even if you had been drinking, you have rights, and there are always options to discuss.
